In this paper I provide a theoretical framework for conceptualising the use of moral education in P4C by drawing on Ann Sharp’s work. I use this framework to present my own pedagogical action research in an elementary school in Taiwan. I use both quantitative and qualitative data to document students’ moral growth. The results indicate that moral education takes place in a morally stimulating environment, namely, a thinking and caring community of inquiry, with a morally-infused approach to doing P4C in (...) a Confucian society like Taiwan. In this study I employed a Confucian interpretative lens to develop relevant classroom rituals and strategies for creating moral winds in the classroom. The conception of moral education presented in this study provides a glimpse of what P4C classrooms may look like in a global context. (shrink)

Patients who are subject to compulsory care constitute a substantial proportion of the work-load of mental health professionals, particularly psychiatric nurses. This article examines the traditional ‘beneficence-autonomy’ approach to ethics in compulsory psychiatric care and evaluates it against the reality of daily practice. Risk to the public has always been an important but often unacknowledged consideration. Inequalities exist among ethnic and socio-economic groups and there is a lack of agreement on what constitutes mental disorder. Two major changes in compulsory psychiatric (...) care - community orders and care for patients with untreatable severe personality disorders - further challenge the traditional ethical approach. There are also important human rights implications. The simple patient-health professional relationship no longer provides an adequate framework for mental health professionals on which to base their ethical decisions. The public and organizations may have different perspectives and their interests are becoming increasingly important. Mental health professionals, particularly psychiatric nurses, may face ethical dilemmas because of these different perspectives. (shrink)

Policies on whether student and qualified nurses should be screened for bloodborne infections and whether infected individuals should be excluded from work must be based on sound ethical principles. Patients have rights, and nurses and employers have duties to respect these rights. However, nurses also have rights that must be respected by their employers and the State. We explore the various ethical challenges that arise during the practical implementation of an emergency resource allocation protocol. We argue that to implement an allocation plan in a crisis, a hospital system must complete five tasks: (1) formulate a set of general principles for allocation, (2) apply those principles to the disease at hand to create a concrete protocol, (3) collect the data required to apply the protocol, (4) construct a system to implement triage decisions with those data, and (5) (...) create a system for managing the consequences of implementing the protocol, including the effects on those who must carry out the plan, the medical staff, and the general public. Here we illustrate the complexities of each task and provide tentative solutions, by describing the experiences of the Coronavirus Ethics Response Group, an interdisciplinary team formed to address the ethical issues in pandemic resource planning at the University of Rochester Medical Center. While the plan was never put into operation, the process of preparing for emergency implementation exposed ethical issues that require attention. (shrink)

How should physical entities be characterized? Physicalists, who have most to do with the notion, usually characterize the physical by reference to two components: 1. Self-control is integral to successful human agency. Without it we cannot extend our agency across time and secure central social, moral, and personal goods. But self-control is not a unitary capacity. In the first part of this paper we provide a taxonomy of self-control and trace its connections to agency and the self. In part two, we turn our attention to the external conditions that support successful agency and the exercise of self-control. We argue that what we call moral security (...) is a critical foundation for agency. Parts three and four explore what happens to agency when moral security is lacking, as in the case of those subject to racism, and those living in poverty. The disadvantages suffered by those who are poor, in a racial minority or other oppressed group, or suffering mental illness or addiction, are often attributed to a lack of individual self-control or personal responsibility. In particular, members of these groups are often seen as irresponsibly focused on short-term pleasures over long-term good, a view underwritten by particular psychological theories of self-control. We explore how narratives about racism and poverty undermine moral security, and limit and distort the possibility of synchronic and diachronic self-control. Where moral security is undermined, the connection between self-control and diachronic goods often fails to obtain and agency contracts accordingly. We close with some preliminary reflections on the implications for responsibility. (shrink)

The World Health Organisation declared COVID-19 a global pandemic on 11th March 2020, recognising that the underlying SARS-CoV-2 has caused the greatest global crisis since World War II. In this chapter, we present a framework to evaluate whether and to what extent the use of digital systems that track and/or trace potentially infected individuals is not only legal but also ethical.

In this "for and against" book, ethicists Lori Watson and Jessica Flanigan debate the criminalization of sex work. Watson argues for a sex equality approach to prostitution in which buyers are criminalized and sellers are decriminalized, known as the Nordic Model. Flanigan argues that sex work should be fully decriminalized because decriminalization ensures respect for sex workers' and clients' rights, and is more effective than alternative policies.

Recently, a debate has developed between those who claim that essence can be explained in terms of de re modality (modalists), and those who claim that de re modality can be explained in terms of essence (essentialists). The aim of this paper is to suggest that we should reassess. It is assumed that either necessity is to be accounted for in terms of essence, or that essence is to be accounted for in terms of necessity. I will argue that we (...) should assume neither. I discuss what role these key notions – essence and necessity – can reasonably be thought to contribute to our understanding of the world, and argue that, given these roles, there is no good reason to think that we should give an account of one in terms of the other. Para isto, realizou-se uma pesquisa de campo em uma Terra Indígena Kaingang no Paraná, cujo entrevistas forneceram (...) confirmações históricas em relação aos etnoconhecimentos da etnia, da evolução dos aspectos químicos e das atitudes perante a química e os remédios de origem farmacêutica e natural. Drawing on recent work in formal pragmatic theory, this paper shows that the manipulation of discourse structure—in particular, by way of shifting the Question Under Discussion mid-discourse—can constitute an act of epistemic injustice. I argue that the “All Lives Matter” response to the “Black Lives Matter” slogan is one such case; this response shifts the Question Under Discussion governing the overarching discourse from Do Black lives matter? to Which lives matter? This manipulation of the discourse structure systematically obscures the intended (...) meaning of “Black lives matter” and disincentivizes future utterances of it. (shrink)

When I see a tree through my window, that particular worldly tree is said to be ‘in’, ‘on’, or ‘before’ my mind. My ordinary visual link to it is ‘intentional’. How similar to this link are the links between me and particular worldly trees when I see them in photographs, or in paintings? Are they, in some important sense, links of the same kind? Or are they links of importantly different kinds? Or, as a third possibility, are they at once (...) links of the same important kind and also links of importantly different sub-kinds within that kind? This paper takes up these taxonomical questions. After fleshing out (a bit) the characterisation of these different subject-object links, I explain and expand upon an approach to answering the taxonomical questions originally set out by Kendall Walton. I then follow this approach a certain distance, connecting it with the question of how to mark the boundary between perception and cognition. My investigations support the conclusion that the three types of links just described are not importantly different in kind. (shrink)

This paper explores the various ways Aristotle refers to and employs “heat and cold” in his embryology. In my view, scholars are too quick to assume that references to heat and cold are references to matter or an animal’s material nature. More commonly, I argue, Aristotle refers to heat and cold as the “tools” of soul. As I understand it, Aristotle is thinking of heat and cold in many contexts as auxiliary causes by which soul activities (primarily “concoction”) are carried (...) out. This, as I argue, is what it means to call them “tools” of soul. An upshot of this investigation is the fuller picture of Aristotle’s conception of efficient causation it provides in general, and the better understanding of the efficient causal operation of an organism’s nature or soul it provides in particular. Defendants raised the topics of the offense, mitigation, future behaviour and the sentence in different ways and this book explores the pros and cons associated with the different strategies that they used. Based on corpus data, Gruber argues that the application of Austin’s (1962) performative–constative continuum reveals that offense-related utterances that fall closer to the constative end are.. Yat-hung Leung debates Chenyang Li’s view of harmony and benevolence in Confucian teachings: Which is the more fundamental and important value, and ultimate ideal? In The Confucian Philosophy of Harmony, Li delineates a distinctively Confucian conception of “deep harmony” as the basic ideal of Chinese culture and especially Confucianism. Leung questions that depiction of things, arguing that benevolence does and should hold that place of honor. Leung focuses his arguments against two claims: firstly, that harmony should be (...) understood as the supreme value in Confucian thought, and secondly, that the ideal of harmony is of greater value to us today than that of benevolence. Leung points out that in the influential texts and traditions of Confucian philosophy, benevolence is of higher value than harmony. He disputes both the representative nature of the texts Li relies on as well as Li’s portrayals of some of those texts. We more properly understand Confucian harmony and benevolence in the inverse relation, with harmony as the product of benevolence, and thereby come to see that the substantive action-guiding content of benevolence in fact has the greater value to contemporary life. Aryeh Goldberg compellingly argues for a Narrative Coherence Standard (NCS) to bolster existing methods of assessing patients' mental capacity. But his account fails to distinguish between the cognitive abilities of children and adults; consequently, worries may be raised about the scope of the NCS, in particular when we consider child patients. In this article, I argue the NCS cannot plausibly apply to children. Since children's self-conception does not arrive fully formed — but rather is a product of both incomplete cognitive (...) development and socializing factors — I claim children may not possess a sufficiently intimate knowledge of self, and therefore a sufficiently coherent sense of self, as Goldberg demands. Therefore, we should either revise the NCS to accommodate children, adopt an incremental view of consent, or revert to the relevant form of the MacArthur competence criteria to establish children’s capacity to consent. En matière de criminalité, le Japon fait figure d’exception. La population incarcérée y diminue en moyenne de 3,6 % par an et le taux de criminalité est en baisse depuis 2007. La densité d’incarcération dans les prisons japonaises n’est que de 74 % contre 120 % en France en avril 2017. Le Japon partage l’appareil démocratique et le développement économique des pays occidentaux mais se distingue par son éloignement géographique et culturel. Or les sciences criminologiques étudiant la philosophie d’un pays (...) et ses traditions idéologiques sont fondamentales dans la réflexion sur la criminalité. Elles témoignent du fait que le crime est autant influencé par le droit, l’histoire et l’économie d’un pays, que par l’ancrage culturel d’une civilisation qui possède ses propres schèmes mentaux et comportementaux. In this paper we investigate nonnormal modal systems in the vicinity of the Lewis system S1. It might be claimed that Lewis's modal systems (S1, S2, S3, S4, and S5) are the starting point of modern modal logics. However, our interests in the Lewis systems and their relatives are not (merely) historical. They possess certain syntactical features and their frames certain structural properties that are of interest to us. Our starting point is not S1, but a weaker logic S1 (S1 (...) without the schema [T]). We extend it to S1D, which can be considered as a deontic counterpart of the alethic S1. Soundness and completeness of these systems are then demonstrated within a prenormal idiom. We conclude with some philosophical remarks on the interpretation of our deontic logic. (shrink)

Imogen Dickie's book Fixing Reference promises to reframe the investigation of mental intentionality, or what makes thoughts be about particular things. Dickie focuses on beliefs, and argues that if we can show how our ordinary means of belief formation sustain a certain connection between what our beliefs are about and how they are justified, we will have explained the ability of these ordinary means of belief formation to generate beliefs that are about particular objects. A worry about Dickie's approach is (...) that the explanation it offers is circular and thus not a genuine explanation of mental aboutness. This article develops a version of that worry in detail and turns it aside. Nonetheless, I argue that the explanatory value of the account remains unclear. While it does promise a dialectical advance over traditional theorizing about aboutness, it does not reveal how our ordinary means of belief formation make beliefs be about what they are about. This essay introduces the main arguments in Lucia Rafanelli’s Promoting Justice Across Borders: The Ethics of Reform Intervention (Oxford University Press, 2021). I place the book within the context of literatures on foreign intervention and global justice more broadly, review the major arguments Rafanelli develops in her book, and foreshadow some of the main points of critique and appreciation put forth by four engaging responses from: Paulina Ochoa Espejo, David Owen, Jennifer Rubenstein, and Arash Abizadeh.

As the first poem of the last book of Ovid'sAmores, 3.1 parallels the programmaticrecusatioof the first two books, which present the traditional opposition of elegy to epic. InAmores3.1, the personified Elegy and Tragedy compete for Ovid's poetic attention, and scholars have accordingly scrutinized the generic tension between elegy and tragedy in this poem. My study, by contrast, focusses on the import of the metapoeticlocusin which Ovid sets his contest between the two genres, by considering the linguistic and allusive play in (...) the opening lines. Ovid exploits the metaphor of literary tradition as an ancient and sacred forest to transform an author's choice of poetic genre into a walk in the woods. Moreover, allusions to Virgil'sAeneid6.179 and Ennius'Annales175 (Sk.) in the first line guide Ovid's audience to expect the more traditional opposition of elegy and epic. The less conventional contest between the genres of elegy and tragedy soon overturns this expectation; nevertheless, elegy's customary opposite, epic, maintains a presence in the form of a woodland context for Ovid's innovative generic opposition. In the Critique of Judgment, Kant claims that genius is a talent for art, but not for science. Despite his restriction of genius to the domain of fine art, several recent interpreters have suggested that genius has a role to play in Kant’s account of cognition in general and scientific practice in particular. In this paper, I explore Kant’s reasons for excluding genius from science as well as the reasons that one might nevertheless be tempted to think that his account (...) allows room for the scientific genius. I then argue that Kant’s concerns are not only epistemic, but also moral, and together, they give us good reason for resisting the veneration of genius. (shrink)

This paper studies the attempts (and failure) of Russian revolutionaries to mobilize the peasantry in the decade leading to the Soviet revolution of 1917. Peasants, who had been emancipated from serfdom only four decades earlier, in 1861, were still largely propertyless and poor. This would, at first glance, make them a ripe target for revolutionary activity. But peasants were largely refractory. We explain this lack of revolutionary spirit through two models. First, despite their lack of education and political awareness, the (...) peasants were rational in their refusal to participate in revolutionary activity; they engaged in a cost–benefit calculus which pushed them away from revolt and political organization. Second, based on the Wildavsky–Thompson cultural types, Russian peasants were largely fatalist: they believed they had no influence on the world, so it was not worth attempting to change it. This paper sheds light on some aspects of the Russian revolution, but also encourages further research in history and economic sociology on the interaction between culture and incentives. (shrink)

Prison as a Torturous Institution Philosophers working on torture have largely failed to address the widespread use of torture in the U.S. prison system. Drawing on a victim-focused definition of torture, I argue that the U.S. prison system is a torturous institution in which direct torture occurs (the use of solitary confinement) and in which torture is allowed to occur through the toleration of sexual assault of inmates and the conditions of mass incarceration. The use and toleration of torture expresses (...) and reinforces the moral exclusion of those subjected to it, particularly African Americans. Importantly, this moral exclusion and the experience of torture may be created and reinforced through institutional practices independently of the intentions of individuals acting within those institutions. By prioritizing torture victims’ experiences and severing the link between torture and intention, my account forces a recognition that, far from being inconsistent with U.S. values, torture is deeply embedded within U.S. institutions.
